Letter 25

Hilary of RomeUnknown|pope hilary
From: [Roman Synod / Pope Hilary's associates]
To: [Record of the synod dealing with the Hermes case]
Date: ~465 AD
Context: Pope Hilary's letter 17; record of the synodal proceedings in the case of Hermes, the irregularly consecrated bishop, as examined by the Roman synod.

Record of the synodal proceedings in the case of Hermes.

Those present at the synod examined the case of Hermes on the day appointed. The facts of the case having been laid before the assembly, and the examination of the witnesses having been completed, Hilary determined, on the basis of what he found regarding Hermes's conduct, that the charges against him were neither proven nor disproven to a degree that allowed a definitive judgment on his personal character.

The canonical question, however, was clear and was separately resolved: the manner of Hermes's consecration was irregular, and the irregularity constituted a problem that required remediation.

The determination of the synod: the canonical defect of the ordination is to be addressed through the formal procedure for validating irregular ordinations; the bishop who performed the irregular ordination is to be formally admonished and required to appear before the relevant metropolitan; and the situation in the affected diocese is to be regularized under the metropolitan's supervision.

These determinations are to be communicated to all relevant parties and are to be implemented within sixty days.

By order of the synod assembled under Pope Hilary.
